1. INTRODUCTION

These Terms & Conditions (“Terms”) govern participation in the event titled “Dead By Daylite” (“Event”), organised and managed by DBD Eventz, their affiliates, partners, sponsors, contractors, agencies, employees, volunteers, representatives, venue partners, production partners and associated entities (“Organisers”).

By registering for, purchasing access to, attending, participating in or otherwise engaging with the Event in any capacity, all participants (“Participants”) acknowledge that they have read, understood and voluntarily agreed to be legally bound by these Terms.

If a Participant does not agree with any provision herein, they must not register for or participate in the Event.


2. ELIGIBILITY

2.1 Participants must be at least 18 years of age on the date of the Event.

2.2 Valid government-issued identification may be required at entry, including but not limited to:

– Aadhaar Card

– PAN Card

– Passport

– Driving License

– Voter ID

2.3 The Organisers reserve the absolute right to:

– approve or reject registrations;

– deny entry;

– disqualify any Participant;

– remove any Participant from the Event premises; without obligation to provide reasons.

2.4 Any false, misleading, incomplete, fraudulent or impersonated registration details may result in immediate cancellation of participation without refund.


3. REGISTRATION & ENTRY

3.1 Registration for the Event is subject to limited availability and confirmation.

3.2 Standard registrations may undergo a screening or approval process.

3.3 FastTrack Entry participants may receive direct confirmation subject to payment verification and compliance with all Event rules.

3.4 Payment of registration fees does not guarantee continued participation, advancement in the Event, prize eligibility or immunity from disqualification.

3.5 The Organisers reserve the right to:

– modify Event capacity;

– alter participant limits;

– close registrations without notice;

– deny admission in the interest of safety, logistics, conduct or operational concerns.

3.6 Tickets and registrations are non-transferable unless expressly approved in writing by the Organisers.

3.7 Duplicate, fraudulent, resold, unauthorised or tampered registrations may be cancelled immediately.


4. EVENT FORMAT

4.1 Dead By Daylite is a live entertainment and competitive gameshow experience involving physical, mental, strategic, immersive and interactive challenges.

4.2 The Event may involve:

  • loud music;
  • flashing lights;
  • smoke/fog effects;
  • crowd interaction;
  • physically demanding activities;
  • emotionally intense scenarios;
  • timed competitions;
  • elimination rounds;
  • immersive production environments.

4.3 The Organisers reserve the right to:

  • modify games;
  • alter rules;
  • add or remove challenges;
  • change formats;
  • adjust schedules;
  • alter prize structures;
  • substitute components;

without prior notice.

4.4 Decisions made by the Organisers, judges, moderators, referees or Event management shall be final and binding.


5. HEALTH & MEDICAL DISCLOSURE

5.1 Participants acknowledge that participation may involve physical exertion, stress, fatigue, environmental exposure, accidental contact, slips, trips, falls, collisions or injuries.

5.2 Participants voluntarily assume all risks associated with participation.

5.3 Participants confirm they are medically fit and physically capable of participating.

5.4 Participants with any of the following are strongly advised against participation unless medically cleared:

  • heart conditions;
  • respiratory issues;
  • epilepsy;
  • seizures;
  • severe anxiety disorders;
  • mobility impairments;
  • pregnancy;
  • recent surgeries;
  • chronic illnesses;
  • neurological disorders;
  • any condition aggravated by stress, loud sounds, flashing lights or physical exertion.

5.5 Participants are solely responsible for:

  • carrying required medications;
  • managing existing medical conditions;
  • informing emergency contacts;
  • seeking independent medical advice prior to participation.

5.6 The Organisers may provide basic first aid assistance; however:

  • medical support availability is not guaranteed;
  • Organisers are not healthcare providers;
  • Organisers are not liable for medical outcomes;
  • emergency response times may vary.

5.7 Participants authorise the Organisers to seek emergency medical assistance on their behalf if deemed necessary.

5.8 All medical costs, hospitalisation expenses, ambulance charges, treatments, medications and related expenses shall be borne solely by the Participant.


6. ASSUMPTION OF RISK

6.1 Participants understand and acknowledge that participation involves inherent risks including but not limited to:

  • bodily injury;
  • emotional distress;
  • temporary or permanent disability;
  • property damage;
  • accidents;
  • crowd incidents;
  • environmental hazards;
  • unforeseen operational issues.

6.2 Participation is entirely voluntary.

6.3 Participants knowingly and voluntarily assume all risks associated with participation.


7. RELEASE OF LIABILITY & INDEMNITY

7.1 To the fullest extent permitted under applicable law, Participants irrevocably release, discharge, indemnify, defend and hold harmless the Organisers from and against any and all:

  • claims;
  • demands;
  • losses;
  • damages;
  • liabilities;
  • lawsuits;
  • penalties;
  • costs;
  • legal expenses;
  • injuries;
  • deaths;
  • property losses;
  • emotional distress;
  • reputational harm;

whether direct, indirect, incidental, consequential, special, exemplary or punitive.

7.2 This release applies regardless of cause, including alleged negligence.

7.3 The Organisers shall not be liable for:

  • injuries during games;
  • participant conduct;
  • crowd incidents;
  • weather conditions;
  • technical failures;
  • audio/visual disruptions;
  • delays;
  • transportation issues;
  • theft;
  • lost belongings;
  • cyber issues;
  • internet failures;
  • force majeure events;
  • acts of third parties.

7.4 Participants agree to indemnify the Organisers against any claims arising from:

  • Participant conduct;
  • violation of rules;
  • damage caused by Participant;
  • misconduct;
  • unlawful activity;
  • negligence by Participant.


8. CODE OF CONDUCT

Participants must behave respectfully and responsibly at all times.

The following are strictly prohibited:

  • violence;
  • harassment;
  • discrimination;
  • intimidation;
  • abusive language;
  • threats;
  • vandalism;
  • cheating;
  • intoxication;
  • possession of illegal substances;
  • dangerous behaviour;
  • unauthorised entry;
  • tampering with equipment;
  • disruptive conduct.

The Organisers reserve the right to immediately:

  • remove;
  • disqualify;
  • blacklist;
  • ban;

any Participant violating these Terms.

No refunds shall be provided in such cases.


9. ALCOHOL, DRUGS & INTOXICATION

9.1 Participants under the influence of alcohol, narcotics, illegal substances or intoxicants may be denied entry or removed.

9.2 Possession or use of prohibited substances may be reported to law enforcement authorities.

9.3 The Organisers reserve the right to conduct security screenings.


10. PHOTOGRAPHY, VIDEOGRAPHY & MEDIA CONSENT

10.1 The Event may be photographed, filmed, live-streamed, recorded or otherwise documented.

10.2 By attending the Event, Participants grant the Organisers unrestricted, irrevocable, perpetual, worldwide, royalty-free rights to:

  • photograph;
  • record;
  • reproduce;
  • distribute;
  • edit;
  • publish;
  • broadcast;
  • monetize;
  • advertise;
  • exploit;

Participant names, images, voices, likenesses, performances and appearances.

10.3 Such usage may occur across:

  • social media;
  • websites;
  • advertisements;
  • promotional campaigns;
  • OTT platforms;
  • television;
  • print media;
  • digital marketing;
  • future event promotions.

10.4 Participants waive all rights to:

  • approvals;
  • inspection;
  • compensation;
  • royalties;
  • residuals;
  • claims relating to media usage.

10.5 The Organisers shall own all Event-related recordings and intellectual property.


11. PERSONAL BELONGINGS

11.1 Participants are solely responsible for their belongings.

11.2 The Organisers are not responsible for:

– theft;

– loss;

– damage;

– misplacement;

of any personal property.

11.3 Participants are advised not to carry valuables.


12. SECURITY & ENTRY RIGHTS

12.1 Security checks may be conducted at entry.

12.2 Prohibited items include:

  • weapons;
  • sharp objects;
  • illegal substances;
  • explosives;
  • hazardous materials;
  • drones;
  • professional recording equipment without authorisation.

12.3 The Organisers reserve the right to deny entry to any person deemed unsafe or disruptive.


13. EVENT SCHEDULE & CHANGES

13.1 The Event schedule is subject to change.

13.2 The Organisers may:

– postpone;

– cancel;

– reschedule;

– relocate;

– suspend;

any portion of the Event.

13.3 No liability shall arise due to changes caused by:

  • weather;
  • emergencies;
  • government restrictions;
  • safety concerns;
  • operational requirements;
  • force majeure.


14. REFUND POLICY

14.1 All registrations, tickets, passes and fees are non-refundable unless explicitly stated otherwise.

14.2 No refunds shall be provided for:

– voluntary withdrawal;

– disqualification;

– late arrival;

– denial of entry due to misconduct;

– failure to comply with Terms;

– dissatisfaction with Event format.

14.3 Convenience fees, payment gateway fees, processing charges and taxes may be non-refundable.


15. PRIZES & WINNINGS

15.1 Prize distribution shall be as follows:

1st Place: INR 3,00,000

2nd Place: INR 1,50,000

3rd Place: INR 50,000

15.2 Prize winners will be required to provide:

  • PAN Card;
  • Aadhaar Card;
  • bank account details;
  • cancelled cheque;
  • address proof;
  • identity verification documents;
  • any additional documentation required under applicable law.

15.3 Failure to provide valid documentation within the specified timeline may result in forfeiture of prizes.

15.4 All prizes are subject to verification, eligibility checks and compliance with applicable laws.

15.5 Tax Deducted at Source (TDS) shall be deducted at applicable rates under Indian law.

15.6 As per prevailing Indian income tax provisions, winnings from contests, gameshows, competitions and similar events may attract TDS at 30% plus applicable surcharge and cess under Section 194B of the Income Tax Act, 1961.

15.7 Winners shall be solely responsible for:

– income tax liabilities;

– disclosures;

– filings;

– financial compliance obligations.

15.8 The Organisers shall not provide tax advice.

15.9 Prize distribution timelines may vary based on:

– verification;

– compliance checks;

– operational processes;

– legal requirements.

15.10 The Organisers reserve the right to:

– withhold prizes;

– investigate irregularities;

– disqualify winners;

if fraud, cheating, manipulation or misconduct is suspected.


16. INTELLECTUAL PROPERTY

16.1 All Event branding, concepts, designs, names, graphics, games, visuals, content, trademarks, audio, videos and intellectual property belong exclusively to DBD Eventz.

16.2 Unauthorised reproduction, recording, redistribution or commercial usage is prohibited.


17. DATA PRIVACY

17.1 Participants consent to the collection, storage, processing and usage of personal information for:

  • Event operations;
  • verification;
  • security;
  • communication;
  • promotions;
  • legal compliance;
  • analytics;
  • marketing.

17.2 Data may be shared with:

– sponsors;

– partners;

– vendors;

– payment processors;

– legal authorities;

where necessary.

17.3 While reasonable security measures will be implemented, the Organisers do not guarantee absolute data security.


18. FORCE MAJEURE

The Organisers shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

  • natural disasters;
  • pandemics;
  • strikes;
  • riots;
  • governmental actions;
  • internet failures;
  • power failures;
  • terrorism;
  • civil unrest;
  • technical disruptions.


19. LIMITATION OF LIABILITY

To the maximum extent permitted under law, the total liability of the Organisers arising from the Event shall not exceed the registration amount paid by the Participant.

Under no circumstances shall the Organisers be liable for:

  • indirect damages;
  • consequential losses;
  • reputational damage;
  • emotional distress;
  • loss of income;
  • business interruption.


20. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising in connection with the Event shall be subject exclusively to the jurisdiction of the competent courts determined by the Organisers’ registered operational jurisdiction.


21. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22. RIGHT TO MODIFY TERMS

The Organisers reserve the right to:

– amend;

– revise;

– update;

– modify;

these Terms at any time without prior notice.

Continued participation constitutes acceptance of revised Terms.


22. ACKNOWLEDGEMENT

By registering for or participating in Dead By Daylite, Participants acknowledge that:

– they have read and understood these Terms;

– participation is voluntary;

– they assume all associated risks;

– they release the Organisers from liability to the fullest extent permitted by law;

– they agree to comply with all Event rules and decisions.

24. DISQUALIFICATION & CHEATING

24.1 The Organisers maintain a strict zero-tolerance policy against cheating, manipulation, collusion or unfair practices.

24.2 Participants may be immediately disqualified for:

  • cheating;
  • tampering with games;
  • receiving unauthorised assistance;
  • exploiting loopholes;
  • impersonation;
  • falsifying identity;
  • disruptive behaviour;
  • violating safety instructions;
  • damaging Event property;
  • abusive conduct;
  • threatening staff or participants.

24.3 The Organisers reserve sole discretion in determining violations.

24.4 Disqualified Participants shall not be entitled to refunds, compensation, prize claims or reinstatement.


25. SAFETY INSTRUCTIONS & COMPLIANCE

25.1 Participants must strictly follow all instructions issued by:

– Event staff;

– moderators;

– referees;

– security personnel;

– emergency responders;

– production crew.

25.2 Failure to comply with safety instructions may result in removal or disqualification.

25.3 Participants acknowledge that certain challenges may involve:

  • running;
  • climbing;
  • obstacle navigation;
  • rapid movement;
  • balance activities;
  • confined immersive spaces;
  • physical interaction.

25.4 Participants agree to exercise reasonable judgment and caution at all times.

25.5 The Organisers reserve the right to stop any Participant from continuing if deemed medically unfit, unsafe, intoxicated, aggressive or otherwise incapable of safely participating.


26. WEATHER & ENVIRONMENTAL CONDITIONS

26.1 Portions of the Event may occur indoors or outdoors.

26.2 Participants acknowledge exposure to potential environmental conditions including:

  • rain;
  • heat;
  • humidity;
  • dust;
  • uneven surfaces;
  • loud sounds;
  • lighting effects.

26.3 The Organizers are not responsible for discomfort, inconvenience, illness or delays caused by environmental conditions.


27. ELECTRONIC DEVICES & RECORDING

27.1 Participants may be restricted from using phones, cameras, drones or recording equipment during the Event.

27.2 The Organisers reserve the right to confiscate prohibited recording equipment for the duration of the Event where legally permissible.

27.3 Unauthorised live-streaming, broadcasting, commercial recording or redistribution of Event footage is prohibited.


28. SOCIAL MEDIA & ONLINE CONTENT

28.1 Participants may share personal Event experiences online provided such content:

  • does not violate laws;
  • does not harm the reputation of the Event;
  • does not disclose confidential production details;
  • does not contain hate speech, harassment or misinformation.

28.2 The Organisers reserve the right to request removal of content considered:

  • defamatory;
  • misleading;
  • unsafe;
  • unlawful;
  • damaging to the Event or associated parties.


29. DAMAGE TO PROPERTY

29.1 Participants shall be financially responsible for any property damage caused intentionally, negligently, recklessly or through misconduct.

29.2 The Organisers reserve the right to recover repair or replacement costs.

29.3 Participants may additionally face legal action where applicable.


30. THIRD-PARTY SERVICES & SPONSORS

30.1 The Event may involve third-party vendors, sponsors, contractors, exhibitors, agencies, food providers, activity partners and service providers.

30.2 The Organisers are not liable for:

  • third-party products;
  • food quality;
  • services;
  • delays;
  • independent acts or omissions;
  • third-party disputes.

30.3 Participants engaging with sponsors or third-party vendors do so at their own discretion and risk.


31. FOOD, ALLERGIES & CONSUMPTION

31.1 Food and beverages may be distributed at the Event.

31.2 Participants are solely responsible for managing allergies, dietary restrictions and medical sensitivities.

31.3 The Organisers do not guarantee allergen-free environments.

31.4 Consumption of food or beverages is entirely at Participant discretion.


32. TRANSPORTATION & ACCOMMODATION

32.1 Unless expressly stated otherwise, Participants are solely responsible for:

– transportation;

– accommodation;

– travel arrangements;

– parking;

– associated expenses.

32.2 The Organisers are not liable for:

  • missed transport;
  • traffic delays;
  • parking issues;
  • travel disruptions.

33. LOST & FOUND

33.1 Any recovered lost items may be retained temporarily at the discretion of the Organisers.

33.2 The Organisers do not guarantee recovery of lost property.

33.3 Unclaimed items may be disposed of after a reasonable period.


34. PARTICIPANT REPRESENTATIONS

Participants represent and warrant that:

  • all information submitted is true and accurate;
  • they possess legal capacity to agree to these Terms;
  • participation does not violate any law or contractual obligation;
  • they are not participating on behalf of another individual fraudulently.


35. NO GUARANTEE OF OUTCOME

35.1 Participation in the Event does not guarantee:

  • advancement;
  • qualification;
  • success;
  • visibility;
  • prizes;
  • sponsorships;
  • media exposure.

35.2 All outcomes depend on Event performance, rules, judging criteria and operational decisions.


36. NON-DISPARAGEMENT

Participants agree not to make false, malicious, defamatory or misleading public statements regarding:

  • the Event;
  • Organizers;
  • sponsors;
  • participants;
  • staff;
  • affiliated entities.

Nothing herein restricts lawful reporting rights under applicable law.


37. EMERGENCY RESPONSE & EVACUATION

37.1 Participants must comply immediately with evacuation procedures, emergency announcements and security directives.

37.2 The Organisers may suspend or terminate portions of the Event in emergencies.

37.3 Participants acknowledge that emergency conditions may create delays, crowding or restricted movement.


38. DIGITAL COMMUNICATION CONSENT

38.1 By registering, Participants consent to receiving:

– emails;

– SMS messages;

– WhatsApp communication;

– promotional updates;

– Event reminders;

– operational notifications.

38.2 Digital Communication Consent

By registering for or participating in the Event, Participants expressly consent to receiving communications from the Organisers and their authorised representatives through various communication channels including but not limited to:

  • email;
  • SMS;
  • WhatsApp;
  • phone calls;
  • push notifications;
  • social media messaging platforms;
  • marketing platforms;
  • automated communication systems.

Such communications may include:

  • Event updates;
  • confirmations;
  • reminders;
  • operational instructions;
  • security notifications;
  • promotional campaigns;
  • sponsor communications;
  • future event announcements;
  • surveys;
  • feedback requests.

38.3 Participants acknowledge that communication delivery may depend on third-party network providers and the Organisers shall not be liable for delayed, failed or undelivered communications.

38.4 Participants may opt out of promotional or marketing communications where applicable under law; however, operational and mandatory Event-related communications may still be sent where necessary for participation, safety, administration or compliance purposes.


39. Non-Disparagement

39.1 Participants agree that they shall not knowingly make, publish, distribute or communicate any false, misleading, malicious, defamatory, abusive, harmful or disparaging statements, remarks, allegations or representations regarding:

  • the Event;
  • the Organisers;
  • sponsors;
  • partners;
  • staff;
  • volunteers;
  • judges;
  • vendors;
  • contractors;
  • participants;
  • affiliated entities.

This applies across:

  • social media;
  • online platforms;
  • public forums;
  • interviews;
  • digital publications;
  • livestreams;
  • print media;
  • verbal statements.

39.2 Nothing contained herein shall restrict any Participant from:

– exercising lawful rights;

– making truthful statements required by law;

– reporting unlawful conduct to competent authorities.

39.3 The Organisers reserve the right to pursue appropriate legal remedies in cases involving knowingly false, malicious, defamatory, fraudulent or reputation-damaging conduct.


40. Entire Agreement

40.1 These Terms & Conditions constitute the complete, final and entire agreement between the Participant and the Organisers with respect to the Event and supersede all prior or contemporaneous:

  • discussions;
  • negotiations;
  • communications;
  • understandings;
  • advertisements;
  • representations;
  • statements;
  • agreements;

whether oral, written, digital, implied or otherwise.

40.2 No waiver, amendment, modification or exception to these Terms shall be binding unless expressly made in writing by the Organisers.

40.3 If any provision of these Terms is found invalid, unlawful or unenforceable under applicable law, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

40.4 The failure of the Organisers to enforce any provision at any time shall not constitute a waiver of future enforcement rights.


41. Expanded Release of Liability & Indemnity

41.1 To the fullest extent permissible under applicable law, each Participant irrevocably and unconditionally agrees to release, waive, discharge, defend, indemnify and hold harmless the Organisers and all associated entities including but not limited to:

  • affiliates;
  • sponsors;
  • venue owners;
  • venue operators;
  • production partners;
  • contractors;
  • agencies;
  • volunteers;
  • staff;
  • security personnel;
  • medical personnel;
  • licensors;
  • marketing agencies;
  • digital partners;
  • vendors;
  • employees;
  • representatives;
  • successors;
  • assigns;

from and against any and all claims, demands, causes of action, proceedings, liabilities, damages, losses, penalties, judgments, settlements, fines, costs and expenses including reasonable legal fees arising directly or indirectly out of:

  • participation in the Event;
  • attendance at the venue;
  • travel to or from the Event;
  • interaction with participants or third parties;
  • use of Event facilities;
  • participation in games or activities;
  • medical emergencies;
  • injuries;
  • illnesses;
  • death;
  • emotional distress;
  • mental trauma;
  • loss of earnings;
  • reputational damage;
  • theft;
  • property damage;
  • negligence of other participants;
  • technical failures;
  • security incidents;
  • crowd-related incidents;
  • environmental conditions;
  • force majeure events.

41.2 Participants acknowledge that the Event may involve known and unknown risks, foreseeable and unforeseeable hazards, and potentially dangerous situations inherent to live entertainment and competitive experiences.

41.3 Participants voluntarily assume all such risks, whether caused by negligence or otherwise, and agree that participation is entirely at their own risk.

Under no circumstances shall the Organisers be liable for:

  • indirect damages;
  • incidental damages;
  • punitive damages;
  • consequential damages;
  • special damages;
  • loss of profits;
  • business interruption;
  • emotional suffering;
  • reputational harm.

Where legally permissible, the total aggregate liability of the Organisers shall in no event exceed the actual registration fee paid by the Participant for the Event.

Participants further agree to indemnify and reimburse the Organisers for any liabilities, losses, claims, legal proceedings, penalties or expenses arising from:

  • Participant misconduct;
  • breach of these Terms;
  • unlawful activity;
  • negligence;
  • intentional wrongdoing;
  • damage caused to persons or property;
  • violations of intellectual property rights;
  • violations of law or regulations.
